Sick leave and employment contracts
We manage employment contracts, employee registration and deregistration, and sick leave compensation by applicable regulations.
Sick leave and employment contracts cover establishing employment, registering and deregistering employees, and calculating salary compensation when an employee is temporarily unable to work. This is an area where mistakes lead to fines and labor inspection problems, because the employer has legal deadlines and obligations toward employees, the Central Registry of Compulsory Social Insurance (CROSO), and the Republic Health Insurance Fund (RFZO). Doing it correctly protects you from penalties and ensures employees receive the compensation they are entitled to.
What you should know
- An employment contract is concluded for a fixed or indefinite term and must be concluded before the employee starts working.
- Every employee must be registered for compulsory social insurance via the CROSO portal before they start work, and deregistered no later than three days after employment ends.
- There are also contracts outside employment (temporary and occasional work, service contract, copyright contract) that have different tax treatment and do not carry the same rights as employment.
- Sick leave up to 30 days is borne by the employer, while from day 31 the compensation is borne by RFZO and refunded to the employer, based on the electronic temporary incapacity report (e-sick-leave).
- Salary compensation is calculated at the statutory percentage, usually 65 percent of the base, and 100 percent in cases prescribed by law such as work injury, occupational illness, pregnancy maintenance, care of a sick family member, and organ and tissue donation.
How we handle it
- 01 Contract preparation We draft an employment contract or a contract outside employment tailored to your situation and compliant with the Labor Law.
- 02 CROSO registration We register employees with CROSO on time before they start work and deregister them within the legal deadline when employment ends.
- 03 Sick leave processing We track the electronic temporary incapacity reports and determine whether the leave is borne by the employer or RFZO.
- 04 Compensation calculation We accurately calculate salary compensation during sick leave at the applicable percentage and include it in the payroll calculation.
- 05 RFZO refund We prepare and submit the electronic refund request for sick leave compensation from day 31 and follow up on the payment from RFZO.
